Official translators are very often required to do official translations of Spanish Judgements of civil proceedings into English. A Spanish Judgement given by a Judge in Spain may have to be enforced in the UK if the defendant or debtor is living and working in the UK or has assets in the UK.

A Spanish Judgement is a very complex legal document and therefore it is paramount that an official translator does the translation.

A Spanish Judgement will confirm:

  1. Type of Proceedings, Claimant, Defendant, Court, Lawyers and Procuradores Particulars. The role of the Procurador is very important in the Spanish legal system because the Procurador is the legal representative in Court. However, there is no equivalent of the role of the Procurador in the English legal system. An Official Translator will reflect this in the official translation so that the role of the Procurador is understood. There is no equivalence between the Spanish and English Courts and Tribunals, and the official translator will ensure that the role of the Spanish Courts and Tribunals is understood.
  2. Facts in issue.  They are the main facts to be established.
  3. Legal grounds. The Legal reasons for the decision.
  4. Decision.  The Judge’s ruling.

Another document which often requires to be officially translated into English is a Spanish Divorce Judgment.

A Decree Absolute and a Consent Order will be given by the English Court when a couple get divorced in the UK.

The Decree Absolute confirms that the marriage is to be dissolved.

The Consent Order confirms the agreement reached by the parties and orders the actions to be carried out by the parties

However, a Divorce Judgment will be given by the Spanish Court when a couple get divorced in Spain. There is no equivalent to the Decree Absolute in Spain because it is the Spanish Divorce Judgement the document which confirms the dissolution of the marriage and orders the actions to be carried out by the parties. The Spanish Divorce Judgement tends to be a document longer than the English Consent Order because it includes Facts or Facts in Issue, Legal Grounds and the Decision and the Judge mentions the relevant Spanish laws.

A British couple may get divorced in Spain if they are living there. If afterwards, the ex-spouse who was awarded custody of the children returns to the UK with the children, the official translation into English of the Spanish Judgment will be necessary as the Judgment will confirm which parent has been awarded custody and visitation rights.

The translation into English of the Spanish divorce judgement will be required if one of the ex-spouses is going to remarry in the UK. The official translation will confirm that he or she is now divorced.

Official translations do not need to bear an Apostille or any other type of legalisation to verify their authenticity because official translations are official documents. The legality of an official translation is conferred by the official translator’s certification, stamp and signature.
