The demand for sworn translations of Spanish divorce documents continues to grow because of British citizens getting divorce in Spain if they were living there.
If a couple got married in Spain but they are getting divorced in the UK, they will have to submit the sworn translations into English of, among others, the following documents:
- Their Spanish marriage certificate
- Their Libro de Familia which is the family record in which stamped copies of the marriage, birth of children, etc., are entered for official purposes
- Marriage Articles, Capitulaciones Matrimoniales, by virtue of which the spouses agree the financial regimen which will regulate the marriage and therefore this arrangement must be considered if the spouses decide to get divorced.
If a couple got divorced in Spain and one of the ex-spouses is remarrying in the UK, the sworn translation of the Spanish divorce judgement must be submitted to the relevant registry office in the UK.
A divorce judgment will be given by the Spanish Court when a couple get divorced in Spain. There is no equivalent to the Decree Absolute in Spain because it is the Spanish Divorce Judgement the document which confirms the dissolution of the marriage and orders the actions to be carried out by the parties. The Spanish Divorce Judgement tends to be a document longer than the English Consent Order because it includes Facts or Facts in Issue, Legal Grounds, and the Decision.
Sworn translators must be familiar with the two legal systems (English and Spanish) involved and master their legal terminology to produce accurate translations.
